WiseWorm – End User License Agreement (EULA)

This End User License Agreement (“Agreement”) is a legal agreement between you (“User,” “you,” or “your”) and Goldfinch Hill – the maker of WiseWorm (“Goldfinch Hill,” “we,” “our,” or “us”). This Agreement governs your use of the WiseWorm mobile application (“App”), website, and related services (collectively, the “Services”).
By downloading, installing, accessing, or using the App, you acknowledge that you have read, understand, and agree to be bound by this Agreement. If you do not agree, do not use the App.
This Agreement complies with Apple’s App Store Terms and Conditions, including the Apple Standard EULA.
1. License Grant
Goldfinch Hill grants you a revocable, non-exclusive, non-transferable, limited license to download, install, and use the App on any Apple device that you own or control, subject to the Usage Rules set forth in the Apple App Store Terms of Service.
2. Restrictions
You agree not to:
- Copy, modify, or create derivative works of the App;
- Reverse engineer, decompile, or attempt to obtain source code;
- Circumvent or disable security features;
- Rent, lease, sell, sublicense, distribute, or transfer the App;
- Use the App for unlawful or harmful purposes;
- Use the App in violation of Apple’s App Store policies.
3. Ownership
The App is licensed, not sold. Goldfinch Hill retains all rights, title, and interest in and to:
- The App and its software;
- Designs, graphics, and artwork (including the WiseWorm avatar);
- Documentation and training resources;
- Data models, structures, and logic; and
- All associated intellectual property rights.
4. Privacy & Data Collection
Your use of the App is also governed by the WiseWorm Privacy Policy, which explains:
- What information is collected;
- How data is stored and used;
- How reminders, logs, and analytics function; and
- Your rights under applicable privacy laws.
By using the App, you consent to the practices described in the Privacy Policy.
5. Updates & Changes
Goldfinch Hill may provide updates, bug fixes, new features, or modifications to the App. These may:
- Install automatically; or
- Require manual installation.
Your license extends to updates unless a new license is provided. Goldfinch Hill reserves the right to modify or discontinue features at any time.
6. Third-Party Services
The App may integrate with or rely on third-party tools and services, including but not limited to:
- Analytics providers;
- Cloud storage services;
- QR/NFC technologies;
- Authentication services;
- Notification providers; and
- External data storage or processing services.
Goldfinch Hill is not responsible for:
- The availability of third-party services;
- Privacy practices or data handling by third parties; or
- Service outages, limitations, or changes.
6A. Third-Party Data Storage, Security & Breaches
You acknowledge and agree that:
- Goldfinch Hill does not control or operate any third-party systems used by the App;
- Goldfinch Hill is not responsible for the security or integrity of third-party platforms;
- Goldfinch Hill is not liable for any data breach, unauthorized access, loss, corruption, or disclosure of information that occurs within or through a third-party service;
- Any data synced, stored, or transmitted using third-party tools is subject to those providers’ own privacy policies;
- You assume all risks associated with using third-party services, including potential breaches or failures.
7. Termination
This Agreement is effective until terminated. It terminates automatically if:
- You violate any terms of this Agreement;
- You uninstall or stop using the App; or
- Apple removes the App from the App Store.
Goldfinch Hill may suspend or revoke your license at any time for misuse. Upon termination, you must cease all use of the App and delete all copies.
8. Disclaimer of Warranties
To the maximum extent permitted by law:
- The App is provided “AS IS” and “AS AVAILABLE”;
- Goldfinch Hill makes no warranties, express or implied, including merchantability, accuracy, or fitness for a particular purpose;
- Goldfinch Hill does not guarantee accuracy of logs, reminders, timestamps, analytics, or composting results;
- You assume all risks associated with using the App.
9. Limitation of Liability
To the fullest extent permitted by law, Goldfinch Hill and its owners, developers, and affiliates are not liable for:
- Indirect, incidental, punitive, or consequential damages;
- Loss of data, profits, or business opportunities;
- Issues resulting from user error;
- Failures or breaches of third-party services;
- Device malfunctions or incompatibilities.
If you paid for the App, total liability is limited to the amount paid. If the App is free to use, liability is limited to $0.
10. Apple-Specific Terms
You acknowledge and agree that:
- This Agreement is between you and Goldfinch Hill, not Apple;
- Apple is not responsible for the App or its content;
- Apple has no obligation to provide support or maintenance;
- Apple is not liable for claims related to the App;
- Apple is a third-party beneficiary of this Agreement and may enforce it.
If the App fails to conform to any warranty, you may notify Apple, and Apple may refund the purchase price, if applicable.
11. Indemnification
You agree to indemnify and hold harmless Goldfinch Hill from any claim, liability, damages, losses, or expenses arising out of:
- Your use or misuse of the App;
- Your breach of this Agreement;
- Your violation of third-party rights.
12. Governing Law
This Agreement is governed by the laws of the State of Illinois, without regard to conflict of law principles.
